Frequently asked questions

Common questions on contracts and booking terms

What should booking terms include?

The seller’s identity, the main characteristics and total price of the service, payment method, the changes and cancellation policy, the right of withdrawal where applicable, liability for incidents and the governing law. For package travel, also the mandatory pre-contractual information and insolvency protection.

Which clauses are key in a SaaS or API integration contract?

Service levels (SLA), availability and support, limitation of liability, ownership of data and content, data protection, term, termination and data migration on exit.

Does a traveller who books online have a right of withdrawal?

As a general rule, no for accommodation, transport and leisure services on a specific date, which are excluded from the right of withdrawal in distance contracts. Package travel has its own cancellation regime.

Are terms and conditions drafted with AI good enough?

As a draft, yes; as a final text, not without review. They tend to mix rules from several countries, leave out the mandatory pre-contractual information for package travel or include clauses that consumer law treats as unfair and therefore void. They need to be tailored to your business model.

What contract do I need with a DMC that sells through a tour operator’s website?

A distribution agreement that makes clear who the organiser is vis-à-vis the traveller, who collects payment and in whose name, who is liable for performance of the services, how cancellations and refunds are handled, what pre-contractual information the website displays and how travellers’ data is processed.

Could my booking website make me a package travel organiser without my knowing?

Yes. If travellers on your website combine services for the same trip, such as a flight and a hotel, in a single booking process or at an inclusive price, you may be the organiser of a package, with all the obligations that entails. The new Directive (EU) 2026/1024 also widens the scenarios, for example where the traveller’s details are passed to another trader and the second contract is concluded within 24 hours. The booking flow needs to be reviewed step by step.
